These Terms and Conditions ("Terms") govern your use of Cardwell Web Design & Marketing's website and services, including our Lead Systems & Automation service and its SMS/text messaging program. By using our website or signing up for our services, you agree to these Terms. If you do not agree, do not use our website or services.

Description of Services

Cardwell Web Design & Marketing designs, builds, and maintains websites and web applications for local businesses, and offers optional add-on services including local SEO, content and copywriting, reputation and review management, lead systems and automation (speed-to-lead alerts, missed-call text-back, review requests, and an AI chat assistant), and paid-ads strategy and consulting (audits and guidance only — we do not manage ad accounts or run ad campaigns on a client's behalf).

SMS / Text Messaging Program Terms

These terms apply to Cardwell Web Design & Marketing's SMS/text messaging program in addition to our Privacy Policy, which describes how we handle related information.

• Website inquiry follow-up — optional text messages from Cardwell Web Design & Marketing to people who submit our website forms and explicitly opt in to receive SMS about their inquiry, scheduling, and project-related follow-up.
• Lead Systems & Automation service — messaging workflows configured for businesses that sign up for those services, such as speed-to-lead alerts, missed-call text-back, and review requests.

Eligibility and Consent

If you submit a form on our website, you consent to receive text messages from Cardwell Web Design & Marketing only if you explicitly check the optional SMS consent box at the time you provide your phone number. Consent is not a condition of submitting a form or purchasing services. Businesses that use our Lead Systems & Automation service are responsible for obtaining any consent required for messages sent to their own leads or customers.

Opt-Out and Help

You can opt out of text messages at any time by replying STOP to any message you receive. After opting out, you will receive one final message confirming that you have been unsubscribed. For help, reply HELP to any message, or contact us at cardwelltyler15@gmail.com. Carriers are not liable for delayed or undelivered messages.

Client and User Responsibilities

• Provide accurate information when signing up for services or submitting contact forms.
• Use our website and services only for lawful purposes.
• Do not use our messaging program to send unsolicited, deceptive, or abusive messages.
• Maintain the confidentiality of any account credentials associated with services we provide.

Ownership

Clients who engage Cardwell Web Design & Marketing for a website or web application retain ownership of the code, domain, and content delivered as part of that engagement, subject to full payment of any amounts owed. Cardwell Web Design & Marketing retains ownership of its own tools, frameworks, and pre-existing materials used to deliver services.

Payment

Pricing and payment terms are agreed to separately for each engagement (for example, a website build and its ongoing monthly plan). Fees are due as described at the time of signup; failure to pay may result in suspension of services, including the messaging program.

Disclaimers and Limitation of Liability

Our website and services are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Cardwell Web Design & Marketing is not liable for indirect, incidental, or consequential damages arising from your use of our website or services, including delayed, undelivered, or misdirected text messages.

Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
