These Terms and Conditions ("Terms") govern your use of the Cardwell Web Co ("Cardwell Web Co," "we," "us," or "our") website and services, including our Lead Systems & Automation service and its SMS/text messaging program. By using our website or signing up for our services, you agree to these Terms. If you do not agree, do not use our website or services.

Description of Services

Cardwell Web Co designs, builds, and maintains websites and web applications for local businesses, and offers optional add-on services including local SEO, content and copywriting, reputation and review management, lead systems and automation (speed-to-lead alerts, missed-call text-back, review requests, and an AI chat assistant), and paid-ads strategy and consulting (audits and guidance only — we do not manage ad accounts or run ad campaigns on a client's behalf).

SMS / Text Messaging Program Terms

Businesses that sign up for our Lead Systems & Automation service may receive, and may cause their own leads and customers to receive, text messages as part of the program. These terms apply to that messaging program in addition to our Privacy Policy, which describes how we handle related information.

  • Speed-to-lead alerts — a text notifying the business owner that a new lead has come in through their website.
  • Missed-call text-back — an automatic text sent to a caller when a call to the business is missed.
  • Review requests — a text sent to a customer after a completed job, inviting them to leave a review.

Eligibility and Consent

By signing up for the Lead Systems & Automation service, a business owner represents that they have the authority to receive alerts at the phone number(s) they provide, and consents to receive the text messages described above at those numbers. The business is responsible for making sure its own use of missed-call text-back and review-request messaging to its customers complies with applicable law.

Message frequency varies based on account activity, such as lead volume, missed calls, and completed jobs. You may receive multiple messages per week, or none in a given week, depending on activity.

Opt-Out and Help

You can opt out of text messages at any time by replying STOP to any message you receive. After opting out, you will receive one final message confirming that you have been unsubscribed. For help, reply HELP to any message, or contact us at cardwelltyler15@gmail.com. Carriers are not liable for delayed or undelivered messages.

Client and User Responsibilities

  • Provide accurate information when signing up for services or submitting contact forms.
  • Use our website and services only for lawful purposes.
  • Do not use our messaging program to send unsolicited, deceptive, or abusive messages.
  • Maintain the confidentiality of any account credentials associated with services we provide.

Ownership

Clients who engage Cardwell Web Co for a website or web application retain ownership of the code, domain, and content delivered as part of that engagement, subject to full payment of any amounts owed. Cardwell Web Co retains ownership of its own tools, frameworks, and pre-existing materials used to deliver services.

Payment

Pricing and payment terms are agreed to separately for each engagement (for example, a website build and its ongoing monthly plan). Fees are due as described at the time of signup; failure to pay may result in suspension of services, including the messaging program.

Disclaimers and Limitation of Liability

Our website and services are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Cardwell Web Co is not liable for indirect, incidental, or consequential damages arising from your use of our website or services, including delayed, undelivered, or misdirected text messages.

Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
